Access to and use of Sagar's Malenadu Products (SMP) and the products and service available through the website are subject to the following terms, conditions, and notices (“Terms of Service”). By browsing through these Terms of Service and using the services provided by our website (www.sagarsmalenaduproducts.com), you agree to all terms of Service along with the Privacy Policy on our website, which may be updated by us from time to time. Please check this page regularly to take notice of any changes we may have made to the Terms of Service.

We reserve the right to review and withdraw or amend the services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or this entire Website.

sagarsmalenaduproducts.com is an online platform selling our products. The portal is selling food ingredients, eco-friendly products, grocery items, beverage ingredients, consumables, and many more products permitted to sell online under the laws of India. Upon placing an order, we shall ship the product to you and be entitled to its payment for the service. Though we name the store with the word Malenadu we are not confined to a specific region alone. 

Color and Exactness of the Product

The images of the items on the website are for illustrative purposes only. Although we have made every effort to display the colors accurately, we cannot guarantee that your computer’s display of the colors accurately reflect the color of the items. Your items may vary slightly from those images. All sizes, weight and measurements of items are approximate; however we do make every effort to ensure they are accurate as possible. We take all reasonable care to ensure that all details, descriptions and prices of items are as accurate as possible.

Pricing

We ensure that all details of prices appearing on the website are accurate, however, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible. If we are unable to contact you we will treat the order as canceled. If you cancel and you have already paid for the goods, you will receive a full refund.

Additionally, prices for items may change from time to time without notice. However, these changes will not affect orders that have already been dispatched. The price of an item includes GST (or similar sales tax) at the prevailing rate for which we are responsible as an Manufacturer/Seller. Please note that the prices listed on the website are only applicable for items purchased on the website and not through any other source.

Intellectual Property Rights

All and any intellectual property rights in connection with the products shall be owned absolutely by the Company. Unauthorized usage of intellectual property/logo/brand name/content/design from our store will be against laws in India. The company shall consider such actions as infringement and will take the matter to courts of law in India.

Law and Jurisdiction

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Karnataka.

Indemnification

You agree to indemnify, defend and hold harmless the Company, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages, or costs arising from your use of this website, your breach of these Terms of Service, or infringement of any intellectual property right.

Violation & Termination

You agree that the Company may, in its sole discretion and without prior notice, terminate your access to the website and block your future access if we determine that you have violated these Terms of Service or any other policies. If you or the Company terminates your use of any service, you shall still be liable to pay for any service that you have already ordered till the time of such termination.

Payment

Upon receiving your order we carry out a standard pre-authorization check on your payment to ensure there are sufficient funds to fulfill the transaction. Goods will not be dispatched until this pre-authorization check has been completed. 

Shipping Policy:

All products listed on our portal are shipped to the customers using reputed courier services in India. Once the payment is made successfully for your purchase, the item will be dispatched within 2-3 working days. There could be delays in the delivery of products in case of natural disasters, calamity, curfew, nationwide bandh, or other unexpected situations. In a normal scenario, the product will reach you within 7-12 working days. We try our best to deliver your order within the lowest possible duration.

Cancellation:

The listed products are exclusively curated with utmost care for quality and consistency. The order can be canceled within 14 hours before the item is shipped. If the order is already shipped there is no scope for cancellation/return or exchange request.

If you cancel the order within 14 hours of time and before the order is shipped then we will refund your 90% of payment retaining 10% of the fee as handling and payment transaction charges.

Return Policy: 

There is no scope for the return of the product if it is delivered in good condition. The return will be entertained only for breakage, damaged and spoiled products with video proof only. However, this will fall eligible for Exchange policy only and can be exchanged by shipping it back to us. In such case shipping charges has to be paid by customers. You can speak to our customer support and then ship it to the appropriate address.

Exchange Policy: 

As mentioned earlier only the damages / broken/spoilt product will be exchanged with the new one. The shipping cost for sending back the product has to be paid by the customer. Once the product reaches us, then only the new one will be dispatched.

Please note: The duration taken for delivery of products is solely dependent on the place where you live and serviceability of the courier services. We will share the shipment tracking number for your reference.

IN NO EVENT WILL THE COMPANY OR IT’S REPRESENTATIVES BE LIABLE FOR ANY DAMAGES, ARISING OUT OF OR RELATED TO MISUSE OF PERSONAL INFORMATION OF THE CUSTOMER AND THE CUSTOMER IS SOLELY LIABLE FOR SUCH ACTS AND THEY ARE ADVISED NOT TO SHARE THEIR CONFIDENTIAL INFORMATION LIKE SMP LOGIN PASSWORD, OTP, CREDIT/DEBIT CARD EXPIRY AND CVV WITH ANYONE EVEN THOUGH THEY CLAIM TO BE A SMP EMPLOYEE. NONE OF OUR EMPLOYEE WILL ASK FOR SUCH CONFIDENTIAL INFORMATION.
